1. Agreement Overview
These Terms of Service form a binding agreement between you ("User") and FarmScope Inc. ("Company", "we", "us") governing your use of the FarmScope platform.
By creating an account, downloading the application, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Subscription & Billing
Pricing varies by subscription tier (Grow $40/mo, Optimize $60/mo, Enterprise $100/mo), billing frequency, and regional adjustments. Prices are in USD.
Subscriptions automatically renew unless cancelled. You have the right to cancel and receive a proportional refund within 14 days of purchase, provided you have not exceeded fair-use limits.
3. Data Ownership & Your Rights
You retain full ownership of all Farm Data. This includes plant records, animal records, inventory, financial records, photos, and all information you create or upload.
Your rights include:
- Access: Access all your data anytime, download in standard formats (.CSV, .JSON)
- Correction & Deletion: Correct inaccurate data, delete data you no longer need
- Data Portability: Request complete export in machine-readable format
- Sharing: Authorize third parties (veterinarians, buyers) to access your data
We will NOT restrict your ability to share data based on competitive concerns.
4. Paddle Disclosure
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
5. Refund Policy
We offer a 30-day money-back guarantee on all subscriptions. If you are not satisfied with FarmScope within 30 days of purchase, you may request a full refund, provided you have not exceeded fair-use limits for your subscription tier.
To request a refund, contact us at support@farmingerp.com with your account details and reason for cancellation. Refunds are processed within 7-14 business days to your original payment method.
6. Privacy & Data Protection
Your use is governed by our Privacy Policy. We process data based on contractual necessity, explicit consent, or legal compliance.
We implement industry-standard security: SSL/TLS encryption, AES-256 at rest, role-based access, 24/7 monitoring.
7. Security & Data Breach Response
If a Data Breach occurs involving your personal data, you will be notified within 72 hours. You have the right to know what was compromised, receive protective guidance, and terminate your subscription with a full refund within 30 days.
We cannot and will not waive liability for Data Breaches.
8. Termination & Your Data
You may cancel at any time. Upon cancellation, you have 30 days to download/export your data. After 30 days, data may be deleted. Reactivation within 30 days restores your data.
9. Regional Addenda
European Users: GDPR applies. You have 14-day withdrawal right, DPA contact rights, and EU Data Act compliance.
African Users: Local data protection laws apply (POPIA, NDPA, Kenya DPA, etc.). Ethiopian data is stored exclusively in Ethiopia (mandatory localization). No international transfers without consent.
Gulf Users: Saudi PDPL, UAE PDPL, Oman law apply. All processing requires explicit consent (especially Oman, UAE). Data localization preferred.
10. Limitation of Liability
Except for Data Breaches, fraud, or IP infringement, our liability is limited to fees paid in the last 12 months. We are not liable for indirect or consequential damages.
Full liability applies for breaches caused by our negligence or violations of law.
